An unannounced follow-up complaint investigation visit was conducted by Licensing Program Analyst (LPA) Y. Yang to present the findings of the investigation. The complaint alleged that facility staff left a daycare child in a soiled diaper for an extended period of time. Specifically, it has been alleged that on multiple occasions, child C1 was left in a soiled diaper for up to four hours while at the facility. Additionally, in one instance at pick-up time, child C1 was reportedly found with both urine and feces in their diaper.

Today, the LPA met with Center Director Nicole Del Calvo to discuss the investigation’s findings. During the LPA’s initial visit on July 29, 2025, Director Del Calvo was interviewed about the allegation. The director denied it, stating that children’s diapers are always changed every two hours or sooner, depending on soiling. Director Del Calvo stated that children are also changed before being picked up in the afternoon by their authorized representative. Director Del Calvo stated that if a child is picked up from the outdoor play yard or before their scheduled diaper change time, teachers will offer to change the diaper if needed before the child is signed out. Director Del Calvo added that the center maintains extra diapers in case children forget to bring them from home or run out during the day.

Director Del Calvo explained that the facility uses an in-house KinderCare application to communicate with families and log mealtime details, diaper changes, and provide a daily report on their child. According to Director Del Calvo, company policy requires teachers to record each diaper change immediately. However, she acknowledged that when teachers are busy, the app is not always updated in real time. Director Del Calvo acknowledged that, while diaper changes reportedly occur promptly, the app does not always reflect those changes and may appear to show that several hours passed between changes. Director Del Calvo stated that teachers prioritize providing care and supervision over administrative tasks, though they attempt to update the app as soon as possible.

Throughout the investigation the LPA conducted unannounced visits on July 29 and August 6, 2025 to interview staff members and make observations. During those visits interviews with staff S1 through S13 and observations inside classrooms did not produce any corroborating evidence supporting the allegation. The statements given by staff were consistent with the center director’s claims that children’s needs are being met and diapers are changed in a timely manner. Client interviews also did not produce any corroborating information to support the allegation. While observing classrooms the LPA saw teachers supervising and engaging all children, changing diapers and assisting with toileting.

Based on available information and interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegation is determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the center director, Nicole Del Calvo. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
