A case management inspection was conducted at the facility by Licensing Program Analyst (LPA) Y. Yang in response to an Unusual Incident Report (UIR) received on March 19, 2026, concerning personal rights violations involving multiple children (C1, C2, and C3) and one staff member (S1).

During today’s visit the LPA met with Center Director Nicole Del Calvo to discuss the reported incidents, gather additional information, and conduct staff interviews. The Director reported that on March 13, 2026, she was informed of an incident that occurred on March 10, 2026, in which staff member S1 denied child C1 access to the bathroom during naptime. As a result, C1 soiled themselves while on their cot. The Director stated that S1 was alone in the classroom at the time and this incident was not observed by another staff member. The incident was reported the following day by C1 to their teacher (S2), who then notified the director. Upon learning of the allegation, the Director placed S1 on administrative leave and conducted an internal investigation with the Assistant Director.

Director Del Calvo further reported that on March 12, 2026, S1 pulled child C2 by the arm while on the playground to remove the child from the area, resulting in a hand shaped bruise on C2’s arm. The incident was reported to the Assistant Director after C2 informed their parent. Additionally, the Director stated that on March 13, 2026, staff member S3 reported observing S1 pull child C3 by the arm to lift the child from a bench on the playground. S3 witnessed the interaction from an adjacent playground and reported the incident to the Assistant Director.

Director Del Calvo stated that she notified District Leader Lisa Sauter and submitted an electronic notification to Community Care Licensing on March 13, 2026, followed by a written UIR received on March 19, 2026. Upon completion of the internal investigation, S1's employment was terminated, and the authorized representatives of the involved children were notified.

California Code of Regulations, Title 22, is being cited on the attached LIC 809-D. An exit interview was conducted, and this report was read and discussed with the center director, Nicole Del Calvo. A notice of site visit was given and must remain posted for 30 days. Appeal rights provided. Reports citing Type A violations are to be provided to parents/guardians of children currently enrolled by the next business day or the next day the children are in care, and to parents/guardians of children newly enrolled at the facility for the next 12 months from the date of this report. Parents/guardians must sign form LIC 9224 to be kept in each child's file.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Director Del Calvo reported that staff member S1’s employment was terminated immediately upon completion of the facility’s internal investigation. To ensure that similar deficiencies do not recur, the Director will implement mandatory in-service training for all staff. The training will focus on children's personal rights, including but not limited to dignity, respect, and protection from inappropriate conduct.

Based on the Center Director’s statements on 4/14/26 and the Unusual Incident Report (UIR) submitted by the facility on 3/19/26, it was determined that staff member S1 violated the personal rights of children C1, C2, and C3 on more than one occasion by denying a child the ability to use the bathroom and by roughly handling two children in care. This posed a potential health and safety risk to persons in care.

The training will be conducted by the Director, and all current employees will be required to attend.Documentation of this POC will include a sign-in sheet verifying attendance, with staff names and signatures. Additionally, detailed training materials and an outline of the topics covered will be maintained. These documents will be submitted to LPA as evidence of compliance.
