32 | The Licensee stated that she does not yell at children but does raise her voice with the children on occasion to get their attention. The Licensee stated that the children in care can become loud when playing inside facility and are unable to hear her if she speaks to them in her regular tone or volume. The Licensee stated that she has never threatened or intimidated a daycare child.
During the investigation, interviews were conducted with staff members S2-S3 on 03/03/23, S4 on 5/24/23, daycare children, clients, and other adults. The staff members that were interviewed corroborated the licensee’s statements. Daycare children that were interviewed reported that they have not been roughly handled or yelled at by the Licensee or any other staff member but have observed and heard the Licensee raising her voice with daycare children. Children interviewed stated that they felt safe while in care. The clients that were interviewed all stated that they have never observed any personal rights violations at the facility. One adult interviewed during the investigation reported that they have observed the Licensee yelling at and roughly handling daycare children. The LPA was unable to corroborate this. During the LPA’s initial visit to the facility on 03/03/23 and today’s follow up inspection visit, the LPA did not observe any evidence of children being yelled at or roughly handled by a staff member.
Based on available information, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s Licensee, Gwendolen Foursha. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit. |
