Licensing Program Analyst (LPA), Leticia Rosales-Meza conducted a subsequent complaint investigation inspection, for the purpose of delivering complaint findings, and met with the Licensee, Luz Elena Aguilar. It was alleged that child sustained unexplained bruise while in care, specifically Child 1 (C1) had a bruise on face. It was alleged that Licensee handled day-care child in a rough manner, specifically Licensee grabs C1’s head in a rough manner. It was alleged that Licensee yells at children in care, specifically Licensee yells at all children in the facility for no reason.

During the initial complaint investigation to the facility on 8/29/23, records were reviewed, and the LPA conducted an interview with the Licensee at 4:25 PM. The Licensee denied the allegations and stated nobody has mentioned, any parent nor have I seen any bruise on a child. I'm constantly checking the children. Licensee stated that C1 cried a lot and sometimes it seemed like if C1 was choking so I would immediately hold C1's head and turn C1 over like they showed us in CPR, to prevent anything to happen, but C1 was fine. “I’ve never handled day care child in a rough manner”.

Licensee stated I raise my voice a bit when children are being loud or when they are yelling at times when they are playing to get their attention. “I never yell at the children for no reason, nor in a mean way”.

Interviews were conducted with Child 3 (C3) and Child 4 (C4) on 8/29/23. An interview was conducted with Parent 1 (P1) on 11/16/23. An interview was conducted with Parent 2 (P2) on 11/16/23.

According to their statements Licensee cares and treats the children good, and Licensee always provides good meals to the children.

During the inspection tours of the facility, LPA observed the Licensee promptly tending to all the children's needs. LPA observed Licensee guide the younger children by their hand and conducting indoor playtime activities with the children.

Based on interviews conducted, although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, therefore the allegations are Unsubstantiated. There was no Title 22 deficiency cited based on the above findings. Exit interview conducted and report was reviewed and discussed with Licensee, Luz Elena Aguilar. Appeal Rights were provided.


Notice of Site Visit shall be posted for 30 days from today's visit.
