Licensing Program Analyst (LPA), Leticia Rosales-Meza conducted a subsequent complaint investigation inspection, for the purpose of delivering complaint findings, and met with the Licensee, Margarita Better-Stefanski. It was alleged that staff is not changing diapers timely, specifically that Licensee is not changing the children throughout the day. It was alleged that staff are double diapering children, specifically using two diapers. It was alleged that staff are inappropriately disciplining children, specifically the licensee makes the children go to the "creepy room" if they have done something wrong and isolates them.

During the initial complaint investigation to the facility on 10/13/23, LPA Rosales-Meza toured the facility, records were reviewed, and made observations. LPA conducted an interview with the Licensee at 3:30 PM. The Licensee denied the allegations and stated we are changing diapers constantly throughout the day, every two hours or more often, if the child is just a little wet, we change diapers anyway. The license stated we had two children recently that had a rash, one was more like fungus type due to food reaction, and the other one was due to an allergic reaction to “change of diaper type/brand”, but these were not caused in my day care and parents were aware. Licensee stated that she did double diaper a child once recently because child had bad diarrhea and parent didn’t bring extra clothes, parent was aware of this and was fine with it.

The licensee stated, “I do not put double diapers on the children, it was only that incident". The Licensee stated we speak and redirect children and that is only if a child pushes or takes toys away from other children. All the children are treated with respect and dignity, we do not discipline children inappropriately.

Interviews were conducted with Parents (P4-P7) on 1/04/24.

According to their statements Licensee and staff are changing their children’s diapers throughout the day and haven't had any issues with diaper rashes, nor experience seeing their children in a double diaper. Licensee and staff care and treats the children well.

During the inspection tours of the facility, LPA observed the Licensee and Staff changing diapers constantly, using only one diaper. Licensee and staff were communicating with all the children and promptly tending to all their needs.



Based on interviews conducted and records reviewed, although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, therefore these allegations are Unsubstantiated.

There were no Title 22 deficiencies cited during today’s inspection.

Exit interview conducted and report was reviewed and discussed with Licensee, Margarita Better-Stefanski. Appeal Rights were provided.

Notice of Site Visit shall be posted for 30 days from today's visit.
