A follow-up complaint investigation visit was made to the facility today by Licensing Program Analyst (LPA), Y. Yang to deliver complaint investigation findings. During today’s visit, the LPA met with the center’s lead teacher, Maggie Petersen to discuss the findings. It was alleged that the facility has operated over ratio on a specified date.

During the LPA’s initial investigation visit on 09/19/24, the LPA interviewed then acting center director, Daysi Lemus regarding the allegation. Lemus acknowledged that the allegation is true and occurred due to a scheduling conflict. Lemus stated that she was not on site at the time but heard about the situation afterwards from a staff member. Lemus stated that former center director, Jujuan Jaymes was in ratio in a classroom with 14 awake children and one other teacher (staff S2). Lemus stated that when a prospective childcare client arrived on site for a scheduled tour of the facility, Jaymes left the classroom to conduct the tour, leaving staff S2 with the 14 awake children. Teacher-Child Ratio. There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by:

Based on the LPA's interviews with facility staff and the center director Daysi Lemus’ own admission on 09/19/24, it was corroborated that the facility operated out of ratio on a specified date resulting in one staff member (S2) supervising 14 awake children. This posed a potential health and safety risk to the children in care.

Lead teacher, Maggie Petersen stated that the facility will be conducting an all staff meeting/ training event on 10/14/24 and will discuss regulations pertaining to ratios and will submit to the Department a signed staff attendance sheet along with a written statement regarding the topics of the training that were discussed by close of business 10/15/24.

Lemus stated that she is not aware of any other instances where a classroom was operating out of ratio. Interviews with facility staff S1-S6 were conducted by the LPA during the investigation. Staff members that were interviewed corroborated the center director’s statements.

Based on information obtained from interviews, the preponderance of evidence standard has been met; therefore, the above allegation is found to be substantiated. California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D. Appeal rights were provided. An exit interview was conducted, and this report was read and discussed with the lead teacher, Maggie Petersen. The Notice of Site Visit shall be posted for 30 days.
