A follow-up complaint investigation visit was made today by Licensing Program Analyst (LPA), Y. Yang to deliver complaint investigation findings. Previously, an investigation visit was made to the facility by the LPA on 05/23/24. It has been alleged that the licensee (staff S1) yells at children and that the licensee inappropriately disciplines day care children. Specifically, it was alleged that the licensee and her spouse/assistant (staff S2) have yelled at children and used inappropriate forms of discipline such as slapping a child’s hand, roughly grabbing a child by their arm to move the child, and kicking sand at a child.

The LPA met with the facility’s licensee, Debra Durgin today to discuss the investigation findings. During the LPA’s initial 05/23/24 site visit, the licensee and her spouse/assistant were interviewed regarding the allegations. Both individuals denied the allegations. The licensee stated that she does not yell at children in care but does on occasion raise her voice with the children and speaks sternly to them to get their attention. The licensee stated that the children can become loud when playing and are unable to hear her if she speaks to them in her regular tone or volume. The licensee stated that she has never threatened or intimidated a daycare child.

The licensee stated that the facility’s discipline policy is to redirect children and speak to them about their actions. The licensee stated that she also asks children to repeat the facility’s rules to her and to explain why their actions may be inappropriate or hurtful to others. The licensee stated that corporal punishment or other forms of cruel and unusual punishment are never used at the facility. The licensee stated that children are never roughly handled, either. The licensee’s spouse (staff S2) and the licensee’s assistant (staff S3) corroborated the licensee’s statements.

During the investigation, the LPA made observations, interviewed children, staff, and other adults familiar with the facility. The interviews did not provide any corroborating information to support the allegations. During the LPA’s visits to the facility, the LPA did not observe any evidence of personal rights violations or any children being yelled at by a staff member.

Based on available information, although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s Licensee, Debra Durgin. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
