Licensing Program Analyst (LPA) Amy Strother made a subsequent complaint investigation inspection for the purpose of delivering findings, and met with Licensee, Irene Silva (L1). It has been alleged that staff did not prevent inappropriate interactions between children in care; specifically, that children were inadequately supervised and were playing a game “family” involving showing their private parts to one another.

During the initial investigation visit to the facility on 10/13/23, LPA Strother toured the facility, obtained documents and conducted interviews with L1 and one staff member (S1). L1 denied the allegation stating that she is very strict about supervision, which means line of site at all times. On 11/08/23 LPA Strother made an additional visit to the facility, touring the facility and conducting interviews with three children, Child 2 – Child 4 (C2-C4). During the course of the investigation, interviews were conducted with Adult 1 (A1) and Adult 2 (A2) between 10/10/23 and 01/02/24. LPA made several attempts to contact Director (D1) who is currently out on leave. LPA was not able to interview D1.

Staff and one adult interviewed denied the allegation, stating that they have no information about children showing their private parts in connection with any type of game. They stated that they have observed children playing a symbolic game of family, reporting that it consists of children being mom or baby and the mom giving a baby a bottle, type of play or fighting over who wants to be the mom or the dad. One staff and one adult interviewed did report that a child was observed removing their pants while in the play yard, stating that it was an isolated event that did not involve other children, other than a few children observing it occur across the yard, when a teacher called out to the child. According to interviews with children, they either didn’t know what the family game was, or it was described as when you sit and watch the game with food, not at school.
Based on interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that an alleged violation occurred, therefore the allegation is UNSUBSTANTIATED.

This report was reviewed and discussed with Licensee, Irene Silva. Appeal Rights were provided.

Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
