An unannounced follow-up complaint investigation visit to the facility was made today by Licensing Program Analyst (LPA), Y. Yang to deliver complaint investigation findings. It was alleged that facility staff handled children in care in a rough manner and it was alleged that staff have spanked a child in care. Specifically, it was alleged that staff have pulled children by their arms and pushed them to sit down on chairs.

The LPA met with the associate director, Rosie Hornyak today to discuss the investigation findings. During the LPA’s initial investigation visit to the facility on 05/09/24, the center director, Mackenzie Miller was interviewed and denied the allegations. Center Director Miller stated that she is not aware of any instance where staff have pulled or pushed children in a rough manner or have spanked children. Center Director Miller stated that staff may lift and pick up toddlers and preschool age children, but must do so using both hands and lifting under a child’s armpits. Center Director Miller stated that staff are reminded of this lifting method through “coaching sessions.” Center Director Miller stated that spanking and other forms of corporal punishment are never used at the facility.

During the investigation, the LPA made unannounced site visits on 05/09/24 and 06/04/24 to make observations inside the classrooms and interview children and staff members S1-S9. Children that were interviewed did not provide any corroborating information to support the allegations. The staff members that were interviewed corroborated the center director’s statements and stated that they have not observed any staff member roughly handling or spanking a child in care. All staff members that were interviewed stated that they understand that they are mandated reporters and are required by law to report the facts and circumstances that led them to suspect that a child has been abused or neglected. During the LPA’s site visits, the LPA did not observe any evidence of personal rights violations or staff roughly handling any children in care.

Based on available information and interviews conducted, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegations are determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the associate director, Rosie Hornyak. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
