On 06/22/2023, Licensing Program Analyst (LPA), Anita Tristan met with Teacher, Debbie Van Lewen for an unannounced Case Management-Incident. Director, Jonyce O’Neill was on vacation. LPA toured the facility, and a census was taken. An Unusual Incident Report was submitted to the Fresno Community Care Licensing Office (CCL) regarding an incident that occurred on 05/05/2023, where child #1 had hit a teacher a few times and then hit the Director, Jonyce. Jonyce then took the wooden block that child #1 had hit her with and hit child #1’s hand with the wooden block.

LPA interviewed Staff #1 who was also hit by child #1. Child #1 did not return to the facility; last day of attendance was 5/5/2023. Facility discipline policy in place, but was not followed with Child #1.

Based on the information obtained by LPA Anita Tristan that Staff #1 confirmed that Director did hit child #1. Unusual Incident Report states that child #1 was hit with a wooden block; however, Staff #1 confirmed that child #1 was hit with a plastic toy not a wooden block as stated in report.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations a Type B deficiency is being cited today.

Exit interview conducted with Teacher, Debbie Van Lewen. A copy of the Appeal Rights was provided and discussed. Notice of Site Visit to be posted for 30 days.

Teacher stated that they will conduct a staff training on how to handle children and will submit copy of agenda and copy of staff sign in sheet to Licensing by POC due date 7/14/2023.

Based on interviews conducted, it was confirmed that the director hit child #1 with a plastic toy. This poses an immediate risk to the health, safety, or personal rights to children in care.
