On June 10, 2024, Licensing Program Analyst (LPA) Yesenia Fierro conducted an unannounced complaint inspection to provide findings regarding the above allegations. LPA met with Site Supervisor, Debra Martinez. LPA took a census and toured the facility. LPA Fierro explained and discussed the allegations and findings with Site Supervisor. During the course of the investigation, LPA interviewed staff and parents. The investigation revealed the following:

Allegation 1: Staff spoke inappropriately to children in care. The investigation revealed through staff interviews that Site Supervisor and Staff 7 have made inappropriate comments to C1 and C3.

Allegation 2: Staff hit a child in care. The investigation revealed through staff interviews and staff self-admitting that the Site Supervisor, Staff 5, and Staff 7 mishandled children in care on different occasions. Site Supervisor admitted to holding down C1 because they were screaming, kicking, and swinging their arms.

Staff 5 admitted to sweeping the feet of C4 to get them to sit down. Staff interviews revealed that S7 pinched C3 and bonked C4 with a toy block.

Allegation 3: Staff inappropriately disciplined child in care. The investigation revealed through staff interviews that Staff 7 has inappropriately disciplined C4 by pinching them and bonked C4 with a toy block.

Based upon information received through interviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiency is being cited (see 9099-D).

An exit interview was conducted with Site Supervisor Debra Martinez. A copy of this report and Appeal Rights were provided and discussed. A Notice of Site Visit (LIC 9213) form will be posted on the facility's parent's board and must remain posted for 30 days.

Copies of licensing report with Type A violation shall be given to parents/legal guardians of children in care and to parents/legal guardians of children newly enrolled at the facility during the next 12 months. Copies of LIC9224 shall be signed and filed in child's file as proof of receipt.

Director stated she will have each teacher watch video Children Personal Rights in Child Care on CCLD website. Each staff will write at least one page of what they learned and how they will implement what they have learned.
