On September 14, 2022 Licensing Program Analyst (LPA) Brannon, conducted an unannounced Annual Required Inspection for the preschool license. LPA met with Assistant Director, Emily Wall, and toured the facility indoors and outdoors. Days and hours of operation are 7 AM to 5:30 PM, Monday through Friday. Assistant Director verified facility phone number is (209) 847-6820.

There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible. No poisons were observed during the inspection.

Furniture and equipment are in good condition, free of sharp, loose or pointed parts. During today’s inspection LPA observed several children’s play furniture, cubbies and rolling shelving units that need to be anchored.

Playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All toilets and hand washing facilities are in safe and sanitary operating condition. There are four toilets and three sinks. One toilet is not working and will back up. This child’s toilet has been made off limits to children. The three working toilets and working sinks will meet the capacity needs for 45 children. Floors in the facility are clean and safe. Parents provide lunches to their children. Licensee provides two snacks: AM and PM. LPA reviewed with Assistant Director the requirement to provide two food groups when providing snacks to children in care. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors. Areas around high climbing equipment, swings and slides have cushioning material to absorb falls. Licensee is utilizing rubber chip for cushioning. The facility is free of flies, insects and rodents. Facility has one or more functioning carbon monoxide detectors that meet statutory requirements.

Based on LPA's observation, the licensee did not comply with the section cited above.In the classrooms there are play kitchens that can be tipped over and are to be anchored, rolling bookcases that requires the wheels to be locked, cubbies are to be anchored and the tall bookcases house staff purses. Licensee is to ensure staff belongings are inaccessible to children in care. For the outside area, the chain link fencing bolts are too long and need to be three or four threads long. These items pose a potential health, safety or personal rights risk to persons in care.

Assistant Director, Emily Wall, was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Upon notification from the Department, the licensee will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption.

Capacity and limitations as specified on the license are being maintained. Currently, staff do not have current First Aid/CPR. Staff attended First Aid/CPR classes online or from vendors that do not provide EMSA stickers.

Assistant Director or fully qualified teacher(s) designated to act in the director’s absence has been reported to the Department. During today’s inspection, Assistant Director’s transcripts were too faded to read and verify all the required classes were taken.

The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. This facility is utilizing electronic signature as the sign in/out requirement. All children are under supervision, including visual supervision, of a teacher at all times. Facility failed to maintain a ratio of one teacher supervising no more than 12 children in care. Upon arriving at the facility, LPA observed staff #1 outside with 15 preschool children. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child.

LPA reviewed a sample of staff files. LPA observed staff files were missing current AB 1207 – Mandated Child Abuse Training for childcare providers. Staff files contained required immunization and flu declination statement. Menus are posted at least one week in advance where an authorized representative can view them. At this time, licensee is not providing IMS services.

Currently, licensee does not have an infant program. For future reference, LPA discussed the safe sleep regulations with Assistant Director, Emily Wall, and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Assistant Director, Emily Wall, of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA and Assistant Director, Emily Wall, discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights.

Exit interview conducted and report was reviewed with the licensee Assistant Director, Emily Wall.

This report shall be made available to the public upon request. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
