25 | On 08/08/2022, Licensing Program Analyst (LPA) Jeovanna Yanez conducted an unannounced case management inspection. LPA met with Licensee, Connie Vasquez and a census was taken. The purpose of today’s inspection was to address incidents involving Staff #1, that the Department was made aware of.
On 05/26/2022, the Department was made aware of incidents involving Staff #1 in which the health, safety, and personal rights of children in care were alleged to have been violated. The Department investigated these incidents and discovered the allegations to have been UNSUBSTANTIATED. The Investigation also revealed that Licensee had known about these allegations against Staff #1, but did not report this information to the Department. LPA discussed reporting requirements with Licensee and the responsibility of the facility to report all unusual incidents to the Department within 24 hours of occurrence. CCR Section 102416.2(b) states, "The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home." In addition, Licensee was reminded that incidents are to be reported to the Department within 24 hours or by the next business day.
Per California Code of Regulations, Title 22, Division 12, Chapter 3, the following deficiency was found: (see LIC809-D). A copy of appeal rights were provided.
A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee, Connie Vasquez. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
