32 | Based on interviews and witnesses’ observations, it was confirmed that on 03/04/2025 Staff 1 handled day care Child 1 in a rough manner. Based on interviews, it was reported that Staff 1 handled day care Child 2, Child 3 and Child 4 in a rough manner. For example, on various unknown dates Staff 1 pushed a child, squeezed and pulled a child’s hand to pay attention, aggressively grabbed and pulled the child’s wrist, hit a child on the arm, and Staff 1 would place hand on the child’s head and physically turned it to the direction staff wanted child to pay attention to. Child 6 reported witnessing Staff 1 mishandling Child 3 in a rough manner. Facility records showed the teacher in question is no longer employed at the facility.
Based upon observations, and information gathered through interviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.
LPA Cabrera informed facility representative that this report dated 05/07/2025 documents one Type A citation which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.
Also, LPA Cabrera informed the facility representative to provide a copy of this licensing report dated 05/07/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Per California Code of Regulations, Title 22, Division 12, Chapter 1, the deficiency is being cited on the attached LIC 9099D.
