On 06/21/2023, Licensing Program Analyst (LPA) Ruby Ocegueda, conducted an unannounced Annual Required Inspection and was met by Licensee, Marcelina Pompa-Navarro. Also present was Staff #2 (S2). Licensee is Spanish Speaking and LPA Ocegueda conducted the inspection in Spanish. Days and hours of operation are Monday through Sunday from 3:00 AM until 2:00 AM or other hours as arranged.

LPA toured the home inside and outside and a census was taken. Current facility sketch reviewed and Licensee confirmed that one hall bathroom, living room and bedroom #1 are used for providing care and are accessible to children. Today, it was observed that “off-limit” rooms were also accessible. There was a chain lock on top of two bedrooms and garage, but it was not secured today. In the garage there was laundry detergent that was accessible to children. Today, licensee secured each latch on the doors making them inaccessible. There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition on the premises. No poisons were observed during the inspection. In the accessible bathroom sink cabinet, there was Windex brand cleaner and various other cleaning products that read “keep out of reach of children”. The latch on sink cabinet was not secured making the area accessible today. Licensee confirmed the observation and made the cabinet inaccessible again.

There are no fireplaces or open face heaters in the home. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home. The home has working telephone service and LPA confirmed the phone number is (559) 791-5445

LPA discussed Safe Sleep Regulations with licensee. There is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. Report continued to 809-C

Based on observation and interview, the licensee did not comply with the section cited above. Today, LPA Ocegueda observed multiple cleaning supplies (Windex, disinfectant wipes) that read "keep out of reach of children" under the accessible bathroom sink. Today, the garage was accessible and there were multiple accessible detergents at arm’s reach of young children. Outside, LPA observed a 4-foot latter and multiple protruding bolts on wooden posts. This poses a potential health, safety or personal rights risk to persons in care.

Today, LPA observed that licensee made the garage and the bathroom sink under cabinet inaccessible. Today, licensee removed the latter and stated she would place plastic bolt covers on each the protruding bolts. Licensee stated she would complete a statement indicating that she understands that potentially hazardous items should always be inaccessible to children in care. Proof of bolt covers and written statement will be submitted to the Department by POC date 7/5/2023.

Operation of A Family Child Care Home
(a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.

Based on observation the licensee did not comply with the section cited above. Today, LPA observed an infant (child #4) climb onto a bar stool twice and onto the kitchen counter once. Although the licensee and assistant #2 were in close proximity, adequate supervision was not being provided as child was able to climb the stool and onto the counter. Licensee confirmed the observation. This poses a potential health, safety or personal rights risk to persons in care.

Licensee stated she undertstands that infant who is under 18 months climbing onto elevated areas/spaces can cause risk of chlid falling and injury. Licensee stated she would complete a statement indicating how she plans to properly supervise young children and ensure they do not climb onto elevated areas in her home. Proof will be submitted by POC 7/5/2023.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

Based on observation and interview, the licensee did not comply with the section cited above. Today, LPA Ocegueda observed that there was three off limit areas that were accessible to children ( two bedrooms and the garage). The doors had top chain latches, however were not in place today. This poses a potential health, safety or personal rights risk to persons in care.

Today, it was observed that child #6 did not have any emergency contact documents or any other licensing forms at the facility. Licensee stated child #6 was only in care today. This which poses a potential health, safety or personal rights risk to persons in care.

LPA provided a list of documents that should be in children files. Licensee stated she would complete a statement indicating that she understands that all children in care should have a file at the facilty with all pertinent licensing forms and documents. Proof will be submited by POC date 7/5/2023.

Provider physically checks on sleeping infants. Licensee did not have a sleep log for the infant in care today. Infants can be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan was reviewed and provided to licenee. is completed and in file for each infant up to 12 months of age. Infants up to 12 months of age are placed on their backs for sleeping.

Today, LPA observed child # 4 who is an infant under the age of 18 months, climb on to of a kitchen counter without licensee noticing. Licensee and assistant had their back turned and LPA Ocegueda told the licensee that the child had climbed onto the counter. Licensee immediately removed the child and we discussed the observation as it pertained to adequate care and supervision. Approximately 60 minutes later, child #4 again climbed onto a bar stool, causing risk of falling from an elevated area. The child was removed after assistant alerted licensee. Car seats are used for transportation purposes only and are not used for sleeping children. The outdoor play area in the backyard is fenced and was inspected. Outside LPA observed a step latter (approximately 4 ft in height). In addition there were several bolts that were protruding (approximately ¾ of an inch) out at the bottom of multiple posts. Licensee confirmed the observation. Capacity as specified on the license is being maintained.

Licensee has a current roster of the children. An emergency fire/disaster drill has been completed and documented within the last 6 months. Licensee’s Mandated Reporter Training was completed on 6/3/2023. Licensee’s pediatric CPR/First Aid expires on 2/11/2023. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis and measles.

All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home.

Incidental Medical Services (IMS) are not currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies is/are being cited: (see next page, 809 D) Licensee was provided a copy of appeal rights.
