On 04/30/25, Licensing Program Analyst (LPA) Elvira Sierra met with facility Representatives,Glenda Robinson and Brian Winnick to provide them with the findings of the above complaint allegations. Upon arrival LPA observed 3 staff supervising 21 children.

The complainant alleged that Licensee does no ensure sufficient care and supervision is provided to children leading to unexplained injuries and staff utilize inappropriate forms of discipline with daycare children. Also, complainant alleged that staff yelled at daycare children and facility is operating out of ratio. Throughout the course of the investigation LPA Sierra conducted interviews with staff and daycare parents and observed the care and supervision. Based on interviews, it was revealed that staff # yelled at child #1when trying to enforce child #1 to follow rules. Also interviews revealed that staff have placed children in highchairs as a form of discipline and that at times facility has been out of ratio having one staff supervising the children during opening or closing time or when staff have to move to a different room to change a child's diaper.

Based on the information obtained during interviews, the preponderance of evidence standard has been met, therefore the allegations are found to be SUBSTANTIATED. Title 22 Regulation deficiency cited on attached LIC9099-D. Appeal rights were discussed, and a printed version was provided.

LPA Sierra informed Facility Representatives, that this report dated 04/30/25 documents two type A citations. Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Sierra informed facility representatives to provide a copy of this licensing report dated 04/30/25 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

On 04/30/25 Licensing Program Analyst (LPA) Elvira Sierra met with facility Representative, Glenda Robinson and Brian Winnick to provide them with the finding of the above complaint allegations. Upon arrival present in the facility were three upervising 21 children.

The complainant alleged that a minor is supervising day care children in care and that licensee does not ensure sufficient care and supervision is provided to children leading to unexplained injuries. In addition, it was alleged that staff do not ensure that day care children's diapering needs are being met while in care. Throughout the course of the investigation LPA Sierra conducted interviews with staff and daycare parents and observed the care and supervision. LPA received contradicting statements from the interviews with staff and parents. LPA learned that Director's minor children visit the facility regularly and sometimes they interact with the children. Director stated that her children and husband visit the facility, but they never assist or are left alone with the children.

LPA also learned that hat cell phones are being used by staff for personal use preventing staff from providing 100% supervision to children. However, it has not been determined that children sustained injuries as a result of the cell phone use. Interview revealed that facility keep a diaper log and checked diapers every two hours and change them as needed.

Based on the information obtained through documentation and interviews; Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
