On November 19, 2024 at 9:30 AM, Licensing Program Analyst (LPA) Susana Martinez conducted an unannounced Required-3 Year inspection. LPA met with director Stefanie Lawson and advised her the purpose of the inspection. Director provided LPA a tour of the facility inside and outside. There were 20 children in care at the time of the inspection along with 3 staff. The facility is located on the Las Posas Elementary School Campus. Center operates M-F 8:15 AM- 11:15 AM.

LPA observed required licensing documents mounted on the wall at the entrance of the facility. Currently the facility uses an electronic sign-in/sign-out application called Learning Genie. LPA verified that the number of children signed in for today correlate with the number of children present on site. Last disaster drill was observed to be conducted on 11/18/2024. Center provides snacks which are prepared by the School District. Snack menus are provided to parents through Learning Genie.

The center currently uses one room for care, labeled K3. Classroom is equipped with age-appropriate toys, teaching materials, and furnishings for children in care. LPA observed enough restrooms available for children to use. Bathrooms are clean and sanitary. LPA did not observe any hazardous/toxic items accessible to children. First Aid kits were observed to be readily accessible in the room. Carbon monoxide detector was observed inside the classroom which was just tested last week and found to be in working condition.

Children bring water bottles from home which are labeled. Drinking water is readily available for children inside and outside the classrooms. The outdoor playground is fenced and equipped with appropriate shading and has an ample amount of space for children to play. Director states outdoor play yard is shared with elementary school children, but used at different times to prevent commingling. LPA advised Director to submit a waiver request. LPA reminded Director that waste containers need to have tight-fitting covers. LPA observed the playground has age-appropriate toys and structures available for children to use. The areas around or under high climbing equipment have cushioned material. No bodies of water were observed on the premises.

A sampling of children and staff records were reviewed. LPA observed 5 out of 5 children's files to be complete and current. Staff files will be reviewed at a later time as complete files are located with HR.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

The center does not care for infants, but LPA provided the following information: LPA discussed the safe sleep regulations with director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.
To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication.

No deficiencies were issued during today's inspection. Two technical violations were issued for the following:

-CCR 101160(a) Posting License which states: The license shall be posted in a prominent, publicly accessible location in the center. The required posted documents are not located in a prominent, publicly accessible area at the facility as parents/authorized representatives pick up/drop off at the gate and do not have access to the main classroom where documents are posted.

- CCR 101239(f)(1) Fixtures, Furniture, Equipment and Supplies which states: Solid waste shall be stored, located and disposed of in a manner that will not transmit communicable diseases or odors, create a nuisance, or provide a breeding place or food source for insects or rodents. (1) All containers used for storage of solid wastes, including moveable bins, shall have a tight fitting cover that is kept on; shall be in good repair; and shall be leakproof and rodent-proof. LPA observed the outdoor areas trash recipients to be missing tight fitting lids.

LPA provided director with the following resources:
- Child Care Center Self-Assessment Guide for Waivers, Exceptions and Exemptions.
- Director requirement checklist.
- Entrance Checklist.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted, appeal rights were given, and report was reviewed with director Stefanie Lawson.
