32 | Regarding the allegation, Staff hit child in care, LPA interviewed multiple parents. The interviews revealed most parents are happy with the care and supervision their children receive at this facility. Every parent that was interviewed stated they have never observed a staff inappropriately speak to a child or inappropriately handle a child.
LPA also conducted a review of all Unusual incident reports that occurred in the last 12 months. LPA found one unusual incident report (UIR)that was submitted to child care licensing(CCL) by the Easter seals director on 05/14/2024. LPA was able to read what the UIR and how the report described the following: how during pick up on 04/22/2024 C6’s parent approached the manager on site approximately between 4:30pm and 5:30pm and parent informed manager, C6’s stated to me(parent) that, S6 hit C6. The UIR report continued to state, later that day when Parent was giving c6 a shower parent found alleged bruises on C6’s back. Parent shared pictures of the alleged bruises with director then Director shared the pictures with the CCL(LPA Negrete) via email.
LPA also conducted staff interviews which includes all the staff that were present in room #2 on 04/22/2024 during the reported incident. All three staff stated how they did not observe S6 hit C6. All staff interviewed also stated how S6 has never acted aggressively or has ever given them any reason to be concerned in regards to S6’s ability to provide care and supervision to children.
LPA also reviewed the CCC staff hand book. On page 69 of the staff handbook, it clearly states how the CCC has established a policy for prohibited behaviors that include actual or threatened violence against other associates, participants, visitors, or any other persons who are either on the CCC premises or have contact with associates in the course of their duties.
LPA interviewed director and area director who stated they conducted their own investigation. And there investigation also included speaking with C6’s parent. LPA reviewed a copy of a email from C6’s parent to the CCC. LPA reviewed the timeline of the actions the CCC took once the parent of C6 informed the center of the alleged incident. According to the director of the CCC, the investigation conducted did not find any evidence to corroborate the allegation the parent of C6 made against S6.
Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is Unsubstantiated.
Exit Interview conducted and report was reviewed with Director Misbah Saad and Area Director Heather Guerrero. Notice of Site Visit was issued.
