On June 21, 2023, Licensing Program Analysts (LPA) Susana Martinez and Giovani Gonzalez conducted an unannounced Required-1 Year inspection. LPA met with Mary Gossett and advised the purpose of the inspection. LPA's were able to tour the facility inside and out. At the time of inspection there were 26 children in the care of 3 staff members.

Upon arrival director Mary Gossett states two staff members had an emergency this morning. Mary states teachers left around 9:30 am and two children's parents were called at around 10 am. Mary was observed outside with 6 toddlers which belong to room 4. Room 6 had 20 children along with 1 qualified teacher (S2) and 1 aide (S4). At around 11:15 am a staff member (S3) arrived to take over the Toddler's classroom. LPA's reminded Mary about being out of ratio, Mary insisted that the children's parents were on their way. At 11:29 am another staff (S1) member arrived.

LPA's observed required licensing documents mounted on the walls throughout the facility. Last fire drill was conducted on 3/16/2023. Each of the classrooms have age-appropriate toys and furniture readily accessible for children in care. LPA's observed enough restrooms available for children to use. LPA's did not observe any hazards/toxins items accessible to children. The outdoor playground is shaded and has an ample amount of space for children to play. LPA's observed the playground has age-appropriate toys and structures available for children to use.

A sampling of children and staff records were reviewed. LPA observed 5 out of 5 children's files to be complete and current. LPA reviewed three out of three staff files. Upon record review it was determined that S3 was not a qualified teacher. At 12:55 pm, LPA's advised Mary that children needed to be picked up in order to go back to ratio. S3 left and Licensee took her place. Another teacher arrived at 1:25 pm. LPA's also found S1's file to be missing qualifications. CPR current with an expiration date of 9/2024. At the time of inspection one staff mandated reporter certification AB1207 was not available or inside the staff files. Director was reminded a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter certification AB1207 every two years at www.mandatedreporterca.com. LPA verified SB792 Child Care Adult Immunization and Tuberculosis requirements.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.

Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

CCC COMPLETED TESTING AND NO LEAD EXCEEDANCES:
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).
LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA Martinez informed licensee Mary Gossett that this report dated 6/21/23 documents One Type A citation and one Type B citation. Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Martinez informed the licensee Mary Gossett to provide a copy of this licensing report dated 6/21/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Three deficiencies were cited today. One Type A and one Type B which can be found on the attached 809-D.

A notice of site visit was given and must remain posted for 30 days.

LPA observed Licensee step into the toddler room and observed the non-qualified staff member leave. Licensee shall submit a written statement to the Department on how she will maintain ratio requirements per title 22 by close of business 6/23/2022. An office meeting to be scheduled to discuss Department’s concerns with deficiencies and to provide resources for licensee.
