On 06/24/2024, Licensing Program Analyst (LPA) German Negrete conducted an unannounced inspection at the above-mentioned facility to deliver the findings of the above mentioned complaint allegation received on 03/28/2024. LPA met with Director Mary Gossett , LPA toured the center inside and out. LPA observed 3 preschool staff providing care and supervision to 18 children.

The investigations included reviewing staff qualifications, sign in/out sheets of children, and parent interviews of both current and previously enrolled children, as well as LPA observations. LPA also interviewed Director, and staff.

Regarding the allegation#1.Staff does not allow day-care child to use the bathroom.. LPA interviewed multiple parents. The interviews revealed most parents believe the children who are potty trained are allowed to go to the bathroom whenever the need arises. Most Parents who were interviewed believed children who are not potty trained get escorted by staff. Continued on LIC9099-C

Also most parents stated they are unsure of the official bathroom. Furthermore parents who participated in the interviews, all stated they are satisfied with the level of care their children receive.

Staff interviews revealed how staff don’t restrict the amount of times children can go to the restroom. Also staff stated how they utilize their personal cell phones to communicate to other staff when a child goes to the restroom. Director stated, preschool complies with teacher to child ratios, therefore the staff stay in compliance and does not leave children unsupervised in the classroom. All staff that were interviewed stated they do not deny a child's right to use the restroom.

During the investigation LPA received and reviewed parent handbook, children roster, staff handbook, and Children enrollment/acknowledgement documents. LPA did verify a written policy in the parent handbook. This policy outlines constant care and supervision but no guidelines of how staff should keep constant care and supervision when a child leaves the class and goes to the restroom. Director stated, she trained all the staff through verbal communication. There is no document verifying the training at this preschool.

Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is Unsubstantiated.

There were a few parents who stated they are unsure of the official bathroom policy. Furthermore most parent who participated in the interviews, stated they are satisfied with the level of care their children receive.

Staff interviews revealed how staff utilize personal cellphones to communicate to other staff when a child goes to the restroom. Director stated, preschool complies with teacher to child ratios, therefore the staff stay in compliance pertaining to ratios and does not leave the children unsupervised in the classroom in order to walk a child to the restroom.

On 06/24/2024 LPA arrived at the facility. LPA waited for approximately 5 minutes for someone open the gate entrance. LPA observed Assistant Director open the door in room#6. Assistant Director allowed a preschool child (C7) walk out of room#6 in order to allow C7 to use the restroom. Once Assistant Director observed C7 enter the restroom, Assistant Director close the door and went into room#6. LPA was allowed inside by a infant teacher(See LIC811). Infant teacher did not ask LPA to show his badge. LPA observed C7 walk out of the restroom and walk back to room#6 unsupervised(See LIC812).

Based on LPAs observations, interviews, documents collected during investigation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D.”

This requirement was not met as evidence by ...
LPA arrived at the facility. LPA waited for approximately 5 minutes for someone open the gate entrance. LPA observed Assistant Director open the door in room#6. Assistant Director allowed a preschool child (C7) to walk out of room#6 in order to allow C7 use the restroom. Once Assistant Director observed C7 enter the restroom, Assistant Director close the door and went into room#6. LPA was allowed inside by a infant teacher(See LIC811). LPA observed C7 walk out of the restroom and walk back to room#6 unsupervised.

Also Director will draft a plan providing guidelines for staff to follow when a child leaves the restroom and procedes to go to the restroom. This plan will be emailed to german.negrete@dss.ca.gov.
