On September 11, 2024, Licensing Program Analyst's (LPA's) David Roman and Susana Martinez conducted an unannounced inspection to deliver the findings of the above mentioned allegation. LPA's met with the Assistant Director Jessica Cruz and Program Coordinator/Director, Jacqueline Serrano and advised them of the purpose for the inspection. LPA's alongside Assistant Director toured the facility inside and outside. At the time of the inspection there were 70 children in care and 11 adults.

The Department received an allegation indicating children were receiving inappropriate forms of discipline while in care. The investigation included two unannounced inspections, LPA's observations, and interviews of former and current parents of children in care, as well as interviews with random staff and children in the facility. During the interviews it was disclosed and corroborated by staff members that it has been observed that brusque forms of discipline such as: yelling and physical contact have been utilized. Interviews and LPA's observations corroborated with the allegation mentioned above.

Based on LPA’s observations, interviews which corroborated by multiple staff, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 are being cited on the attached LIC9099-D.

One type A deficiency was issued during today’s inspection. LPA’s D. Roman and S. Martinez informed Assistant Director and Program Coordinator that this reported dated 09/11/2024 documents one (1) type A citation which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA’s D. Roman and S. Martinez informed the Director's of their responsibility to provide a copy of this licensing report dated 09/11/2024 that documents the type A citation to parents / guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents / guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224) or other written statement must be placed in the child's file for verification.

A notice of Site Visit (LIC9213) was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. The notice of site visit must remain posted for 30 days or a civil penalty of $100 will be assessed.



Appeal Rights (LIC9058) were provided to the Assistant Director and Program Coordinator/Director.

Exit interview conducted and report was reviewed with the Program Coordinator/Director, Jaqueline Serrano and Assistant Director, Jessica Cruz.

The center is to submit a written statement on how they plan to prevent this deficiency from re-occurring. The center must submit proof of staff training pertinent to Mandated Reporter Training, Children's Personal Rights in Child Care Training, and Standard Operating Procedures Training for Disciplinary Actions.
