On 10/23/25 at 9:30am, Licensing Program Analyst (LPA) Veronica Diaz conducted an unannounced inspection to deliver the findings regarding the above allegations. LPA met with director Marlene Ybarra assistant director Zenaida Garcia Navarrete and explained the purpose of the visit. Together, we toured the facility indoors and outdoors. At the time of the inspection, there were 51 children and 9 staff present.

The Department received a complaint containing the above allegations. The investigation included two unannounced inspections, a review of facility records, and interviews with the director, staff, and parents.

During the investigation, LPA reviewed staff and children’s files, and the facility’s illness policies and procedures. Records showed no unreported incidents or failures to follow health protocols. During both inspections, LPA observed appropriate staff to child ratios and confirmed that staff were actively supervising children. The isolation area was available, and staff demonstrated an understanding of procedures for separating sick children when necessary.

Interviews with staff indicated that they denied the allegations. Staff showed knowledge of proper care and supervision, staff to child ratios, personal rights, and illness reporting procedures. Parents interviewed stated they had not observed staff acting roughly, yelling, or engaging in inappropriate behavior. Parents also said they were satisfied with the care and supervision provided and had no concerns about how the facility responds when children become ill.

Based on LPA observations, record review, and interviews, there was not enough evidence to support the allegations. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

No deficiencies were cited for today. Notice of site visit was given and must remain posted for 30 days. Appeal Rights were provided, and the report was reviewed. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
