On November 6 2023 Licensing Program Analyst (LPA) Giovani Gonzalez conducted an unannounced Required - 3 Year inspection and to address an increase of capacity. LPA met with Licensee Ashley Garcia and informed them the purpose of the inspection. LPA in the company of the Licensee toured the interior and exterior of the FCCH. The FCCH uses a family room, living room, 1 bathroom and the backyard for child care purposes. At the time of the inspection there were 11 children in care and 2 staff present.

LPA observed age appropriate toys, furniture and equipment in the FCCH's interior. LPA observed a fire place in the family room to be covered and inaccessible to children in care. LPA did not observe any medications or sharps accessible to children in care. LPA observed the kitchen to be accessible and that all cabinets/drawers within the reach of children were free of hazards. LPA observed cleaning compounds to be stored in an elevated cabinet beyond the reach of children in an excluded area of the home. LPA observed the bathroom used for child care purposes to be clean and free of toxins.

LPA observed required licensing forms and documents to be posted in the hallway next to the entryway of the FCCH. LPA observed multiple smoke and carbon monoxide detectors in the FCCH. A combination smoke and carbon monoxide detector was tested and found to be operable. The FCCH has a regulation fire extinguisher which was purchased in August. LPA reminds Licensee to either service or purchase a regulation fire extinguisher annually.

The backyard is completely enclosed with fencing. LPA observed the sides of the home to be blocked off and inaccessible to children in care. LPA observed a hot tub that was secured, covered and inaccessible to children in care. LPA observed that the home has 2 chickens and reminded Licensee that the outdoor area must be kept clean.

A sampling of children's records was reviewed. LPA observed that the Licensee had incomplete files for 2 out 5 files reviewed. Licensee's records were also reviewed. Licensee's Pediatric CPR/First Aid expires on 2/14/2024 while their Mandated Reporter Training Expires 12/5/2023. Employee files were reviewed and Staff 1 (S1) was not associated to the FCCH.

Licensee [or facility representative] was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee [or facility representative] was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Fire Clearance was granted 9/25/2023. Licensee is seeking to change the FCCH’s capacity from eight (Small FCCH) to fourteen (Large FCCH). On 11/6/2023, the Department received a fire inspection clearance from from the Ventura County Fire Department for a capacity of fourteen. As such the FCCH's change of capacity to 14 is granted on the present, 11/6/2023.

1 Type A deficiency, 1 Type B deficiency and 1 Technical Violation were cited during today's inspection. Deficiencies can be found on the attached 809-D's. LPA notified Licensee that they must inform all parents of children enrolled, and children that enroll in the next 12 months of the Type A deficiency and have parents sign LIC 9224. LIC 9224 should be placed in child's file.


A notice of site visit was given and must remain posted for 30 days. Exit interview was conducted and report was reviewed with the licensee Ashley Garcia
