32 | The outdoor area consists of one large grass field authorized for use by the elementary school. School property has perimeter fencing; however, manager stated preschool play area will be sectioned off via cones and children under constant care and supervision. LPA observed cones present but lacking play equipment and shaded area. Manager directed LPA to large, locked shed in which age-appropriate toys, equipment, and umbrellas for shade are being housed. Manager stated staff members will be setting up play area shortly. LPA observed large water jug present for outdoor usage. LPA advised manager outdoor play area is to be constructed for use prior to licensure.
Assembly Bill (AB) 2370, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their drinking water for lead contamination. The facility must have its water tested and post the results within 180 days of licensure.
LPA reviewed with applicant the LIC 311A, Records to Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted. LPA discussed information capacity, and ratios. Director was made aware that it is the facility's responsibility to know the current regulations for a facility which can be accessed on-line at www.cdss.ca.gov.
Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
