On 3/3/26 at 11:15am, Licensing Program Analyst (LPA) Tammy Dutra conducted an unannounced complaint inspection and met with facility representative, Daniella Shadd. It was alleged that staff caused injury to daycare child (C1), specifically that a teacher (S1) spanked C1.

The site supervisor was interviewed on 12/9/25 at 9:25am and stated she was informed of the allegation. The site supervisor shared that the allegation had been investigated by the Sheriff’s department. The site supervisor stated C1 had been out sick a week prior to the allegation and staff were provided with a physician’s note. The site supervisor was later informed that C1 had an injury that was alleged to be caused by a teacher. The site supervisor stated they had no knowledge of C1 having an injury while in care. The site supervisor stated they have never seen anyone spank or hurt a child. The site supervisor stated the center practices conscious discipline and there are many tools the staff uses to support behavioral issues such as the calm down area and individual time to process their emotions. The site supervisor stated that C1 never exhibited any injuries while in care and added that when C1 is in distress, their cry is very audible.

Two staff members were interviewed on 12/9/25 and 2/18/26. Both staff denied seeing a teacher cause an injury to a daycare child. Both staff referenced the tools they use to calm a child struggling with their behavior. Both staff stated there is a minimum of two teachers present at all times in the classroom.

Four children were interviewed on 12/9/25. None of the children indicated that children are spanked or hurt while in care. Two of the children shared that they are directed to the calm down area when a child is having a bad day. None of the children expressed fear of a teacher or any negative experiences regarding the facility.
Eight parents were interviewed on 1/30/26 and 2/2/26. None of the parents interviewed had concerns regarding the care their children were receiving. All parents indicated they had been informed the school practices conscious discipline and the teachers use the calm down area to support behavioral issues in the classroom.
One school resource officer (SRO) was interviewed on 12/10/25 regarding the complaint and stated their complaint findings were unfounded. The SRO stated they could not find any evidence of a staff causing harm to a daycare child. The SRO said the facility is a “no hands on” facility and stated it was determined that the injury the child sustained was not consistent with a spanking.

On 12/9/26 LPA received medical documentation from the school regarding C1’s illness. LPA received a copy of the Sheriff’s report on 1/7/26 in which the allegation was deemed unfounded. On 12/16/25 LPA received further medical documentation regarding the injury that C1 sustained. LPA reviewed communication between staff and C1’s representative. Medical documents indicated C1 did sustain an injury, but it could not be determined what caused the injury.

Based on interviews and document review it cannot be determined if staff caused an injury to a daycare child. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated.

Exit interview conducted and report was reviewed with the facility representative Daniella Shadd. Appeal rights were provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
